Intercity Terms of use

1. Introduction

Welcome to IntercityNG (“IntercityNG,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the website, mobile applications, and any other services offered by IntercityNG collectively referred to as the intercity.ng platform (“Platform”).
By accessing or using the Platform, you (“User,” “you,” or “your”) expressly agree to be bound by these Terms and any amendments made from time to time. If you do not agree to these Terms, please do not use or access the Platform.

2. Acceptance and Modification of Terms

2.1. These Terms constitute a legally binding agreement between you and IntercityNG.
2.2. IntercityNG reserves the unilateral right to update, amend, or modify these Terms at any time without prior notice. You acknowledge and agree that your continued use of the Platform constitutes acceptance of such changes.
2.3. You are responsible for reviewing the Terms regularly. IntercityNG is not obligated to provide individual notifications of updates.

3. Nature of the Platform and Service Provider Relationship

3.1. The Platform operates solely as an intermediary, facilitating the connection between Users and independent third-party ground transport and logistics service providers (“Service Providers”).
3.2. IntercityNG does not provide transportation services itself and is not responsible for the acts, omissions, or performance of Service Providers.
3.3. You expressly acknowledge and agree that all contracts for services are directly between you and the Service Providers, and IntercityNG is not a party to such contracts.
3.4. IntercityNG shall have no liability for any damages, claims, losses, or costs arising from the actions or omissions of Service Providers or Users.

4. User Eligibility and Account Registration

4.1. You must be at least 18 years old to use the Platform. By registering, you warrant that you meet this age requirement.
4.2. When creating an account, you agree to provide accurate, current, and complete information.
4.3. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account.
4.4. You agree to notify IntercityNG immediately of any unauthorized use or security breach.

5. Use of Personal Information

5.1. By using the Platform and providing personal data, you consent to the collection, use, and processing of your information as detailed in our Privacy Policy.
5.2. You further consent that IntercityNG may share your contact details with trusted third-party marketing partners for promotional communications, with options to opt-out at any time.

6. User Conduct and Obligations

6.1 You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms.

6.2 You shall not:

Engage in any conduct that may harm, disrupt, or impair the Platform or its users.
Use the Platform to transmit unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable content.
Attempt to gain unauthorized access to any part of the Platform or other users’ accounts.

6.3 IntercityNG reserves the right to suspend or terminate accounts for violation of these Terms.

7. Intellectual Property

7.1. All content, trademarks, logos, and intellectual property displayed on the Platform are owned by or licensed to IntercityNG.
7.2. No rights or licenses are granted to Users other than for permitted personal use.
7.3. Unauthorized use of intellectual property is strictly prohibited.

8. Payment and Fees

8.1.Payments for services offered by Service Providers via the Platform shall be made through IntercityNG’s authorized payment channels.
8.2. By submitting payment, you authorize IntercityNG to charge your payment method for the full amount due, including any applicable taxes, fees, or charges.
8.3. All fees are non-refundable except as explicitly provided in IntercityNG’s refund policy.

9. Limitation of Liability

9.1.To the fullest extent permitted by law, IntercityNG and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, data, or use, incurred by you or any third party arising out of or related to your use of or inability to use the Platform or services.
9.2. IntercityNG’s total liability to you for any claim arising out of or relating to these Terms or the use of the Platform shall not exceed the amount you have paid to IntercityNG in the six (6) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless IntercityNG and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees and costs) arising out of or related to:

Your breach of these Terms.
Your violation of any applicable law or third-party rights.
Your use of the Platform or services.

11. Force Majeure

IntercityNG shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, governmental actions, or technical failures.

12. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to these Terms or the Platform shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Any legal action or proceeding shall be exclusively brought in the competent courts located within Nigeria.

13. Electronic Communications

By using the Platform, you consent to receive electronic communications from IntercityNG, including notices, agreements, disclosures, and other communications related to the Platform.
These communications satisfy any legal requirement that such communications be in writing.

14. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and IntercityNG regarding your use of the Platform and supersede all prior agreements or understandings.
